Barely 24hours after a Jos high court ruled on a motion banning APC, Plasiec others in filling chairmanship candidate for Bokkos LG in the forth coming elections in plateau state, it has on Tuesday fixed the 7th September, 2021 for ruling on the fsh.
The motion before, Justice Ishaku Kunda was brought by the Plateau State Independent Electoral Commission ,PLASIEC ,All Progressives Congress ,APC,and Governor Simon Lalong urging the court to dismiss the petition of the the Chairmanship candidate of the PDP ,Langtang North LGA of filing processes .
Counsel in this matter, Barr .G.S. Pwul ,SAN, who said he filed a motion on notice dated 10th of August, 2021 said he was reading for the business of the day .
He said the motion on notice suffered delay due to the circumstances that occurred in Jos North LGA that is well known to everyone, “we have served on the claimant /respondent on a single prayer”.
According to him ,the grounds stand on 3 issues and was supported by affidavit of 13 paragraphs accompanied by a written address to satisfy the rule of this court .
He urged the court to take judicial notice of the processes filed by the claimant/ respondent following the urgent notice of withdrawal dated 09-08-2021 which all grounds has been exposed .
Pwul explains that the claimant/respondent unilaterally responded citing authority on Dingari against INEC ,stressing that in their suit NO PLD /J/3321/2021 wrongly filed calling on the court to dismiss the application .
While ,countering the argument of defendants ,Barr. Harrison Uguala said ,we have filed a counter affidavit and a written address in position of the application .
He noted that his application dated 11-08-2021 which we placed reliance on all the paragraphs of the counter affidavit by adopting as their oral submission in the application .
However, Uguala said ,the defense counsel only served them this morning urging the court that the matter having been filed today the argument cited by the applicant is not correct the supreme court judgment went contrarily .
Ugwuala maintains that the defendant in page 2 reply that across 210 to 213 (E) (B) the defendants didn’t have any defense here even on their authority cited .
He urged that the defendants should not fogged a death horse by calling on the court to dismiss the application on grounds that it’s lacking in merit .
The judge adjourns for ruling on the application to the 7th September, 2021 .
